Judge Denies Tesla’s Motion to Dismiss ‘Phantom Braking’ Lawsuit

Tesla, a leader in the realm of autonomous driving, finds itself navigating some legal turbulence. In Chicago, a class-action lawsuit titled Joshua Santiago et al. v. Tesla has been cleared to proceed by District Judge Georgia Alexakis, despite Tesla’s efforts to dismiss the case. The suit alleges that Tesla was aware as early as 2015 of a “phantom braking” issue within its vehicles but failed to inform potential buyers.

The plaintiffs claim that Tesla’s forward collision monitoring system experiences false alarms, which can cause sudden deceleration or even a complete stop when no actual collision risk exists. Although Tesla aimed to have the entire lawsuit dismissed, Judge Alexakis decided to streamline the case. She rejected the part of the lawsuit asserting that Tesla’s insurance business overcharged clients due to the phantom braking issue. The court was not convinced that these phantom alerts resulted in higher insurance premiums for drivers.

Tesla contends it only became aware of the problem when a plaintiff purchased a Tesla Model 3 in 2021. However, Judge Alexakis pointed out that potential buyers rely on Tesla’s website for accurate and comprehensive information to make informed purchasing decisions, suggesting Tesla may have omitted critical safety data.

Despite these challenges, Tesla continues to ambitiously advance its autonomous vehicle technology. Recently, they unveiled exciting projects like the Cybercab—a futuristic taxi without a steering wheel or pedals—and the Robovan, designed as a larger self-driving public transportation option.

Tesla’s current lineup includes Autopilot, a standard feature in new models, offering basic functionalities such as Cruise Control and Autosteer. Additionally, the Full Self-Driving (Supervised) package enhances these capabilities with features like Navigate on Autopilot, Auto Lane Change, Autopark, and Smart Summon, available through subscription or a one-time purchase. As Tesla navigates this legal matter, the company remains focused on its goal of revolutionizing transport with cutting-edge autonomous innovation.
