Apple Wins Legal Battle as Judge Dismisses Bribery and Anti-Competition Allegations Involving Visa and Mastercard

In a recent legal battle, Mirage Wine & Spirits, an Illinois-based beverage retailer, along with several other merchants, launched a lawsuit accusing Apple, Visa, and Mastercard of engaging in a scheme to stifle competition while reaping substantial profits by overcharging businesses. This legal action, described as a conspiracy lawsuit, was ultimately dismissed by the Southern District of Illinois, granting a significant victory to the three tech giants.

The plaintiffs alleged that Apple was receiving substantial payments from Visa and Mastercard to avoid developing its own payment network. Since the debut of Apple Pay in 2014, Apple has utilized the payment networks of Visa, Mastercard, and American Express for its transactions. The merchants argued that Apple forged a lucrative relationship with these companies, allegedly accepting payments to discourage competition and prevent the creation of its proprietary payment infrastructure.

Further claims were made regarding Apple’s control over its NFC hardware, essential for ‘tap to pay’ transactions. The plaintiffs argued that this control hindered third parties from introducing alternative payment methods, fortifying the dominance of Visa and Mastercard. Nonetheless, the court concluded that the plaintiffs failed to provide substantial evidence and deemed their claims speculative.

The judge highlighted that Apple’s decision against establishing its own payment network is attributed to the complexity of such an endeavor, rather than any financial incentives from its partners. The plaintiffs further noted that Apple charges 0.15 percent on the value of all U.S. credit transactions and 0.5 cents on each U.S. debit transaction processed through Apple Pay via Visa and Mastercard networks. They suggested that this cost structure suppresses innovation in the industry.

The plaintiffs now have 30 days to amend their complaints and potentially file a second class action lawsuit. Should they fail to meet this deadline, the case will be dismissed permanently.
