An Italian YouTuber is currently in hot water with authorities for allegedly breaching copyright laws, sparking an investigation by the Guardia di Finanza. This situation has already led to a raid that resulted in the seizure of over 30 gaming handhelds, suspected of containing ROM files that violate Italian copyright regulations.
The YouTube channel in question, known for its focus on retro gaming, has been involved in testing gaming handhelds like the Miyoo Mini Plus. This involvement now seems costly, as the Italian financial police are examining potential breaches of law. During a search warrant executed by six officers in April, dozens of gaming handhelds from brands such as Anbernic, Powkiddy, and TrimUI were confiscated.
These specific brands are noted for often including numerous ROM files of unlicensed retro games. Additionally, the YouTuber’s smartphone was taken for a month to extract all stored data. The investigation remains ongoing, and its conclusion will determine whether charges are filed or the case is dismissed. The potential consequences include a fine reaching up to €15,000 (about $17,427) and a permanent ban from the YouTube platform.
The YouTuber, who boasts 48,200 subscribers and 222 videos, suspects that Nintendo may have been the one to alert authorities, though no confirmation exists to support this theory. This case could set a precedent affecting the future of retro handheld testing, especially those preloaded with ROM files. It’s noteworthy that many handheld devices are available without pre-installed games, allowing users to legally add their own game modules.
