Nintendo Lawsuit Looms Over Palworld Developer

The game developer Pocket Pair finds itself embroiled in a legal battle with Nintendo over their popular title, Palworld. Nintendo’s lawsuit is targeting Pocket Pair with an injunction and seeking damages of about 10 million yen, equivalent to around $65,000 USD. While this financial demand might seem minor for a game like Palworld, which has impressively sold over 25 million copies, the injunction is the real concern here. If granted, it could compel Pocket Pair to withdraw Palworld from the market due to the alleged patent infringement against Nintendo and The Pokemon Company.

The crux of the dispute revolves around three specific patents—7545191, 7493117, and 7528390—cited by Nintendo, which supposedly underpin their lawsuit. These patents, which appear to be variations of the same concept, essentially aim to protect the gameplay mechanic where players use projectiles to summon creatures in a 3D environment to fight on their behalf. This mechanic has sparked controversy, as the patents were filed after Palworld had already been announced in June 2021, despite the earliest patent date being December 22, 2021.

It’s noteworthy to mention that while these patents are still pending in the US, Japanese patent law is distinctively strict and allows for patenting gameplay mechanics. This legal framework is often used by companies to gain a competitive edge in the market, though it tends to be unpopular with gaming fans.

Palworld launched in January 2024, available for Windows PC via Steam and the Microsoft Store, as well as PlayStation 5, Xbox One, and Xbox Series X|S. Since its release, it has also been included in Xbox Game Pass. However, given the current legal skirmish, the possibility of a Nintendo Switch version seems uncertain for the foreseeable future.
