Last month saw a significant legislative move in California as the state legislature passed the SB 1047: Safe and Secure Innovation for Frontier Artificial Intelligence Models Act. This ambitious bill aimed to create stringent safeguards for AI systems with development costs exceeding $100 million and utilizing computational power of at least 10^26 FLOPS. It proposed robust checks for AI that could significantly impact various sectors with its advanced computational capabilities.
Despite its passage through the state legislature, SB 1047 encountered its final hurdle when Governor Gavin Newsom opted to veto the bill. The bill had polarized opinions, facing opposition from key figures in the tech industry such as Yann LeCun of Meta and executives from Google and OpenAI, along with certain Democratic politicians like Ro Khanna. On the other side, the bill found support from Elon Musk, who has been a vocal advocate for cautious AI regulation.
Governor Newsom, who had recently authorized 17 other bills addressing various aspects of GenAI technology regulation, chose to halt SB 1047, citing its current inadequacies. He emphasized California’s commitment to responsibly mitigate the risks associated with GenAI deployment while harnessing its benefits. In expressing his concerns, Newsom acknowledged the bill’s good intentions but criticized its lack of consideration for the specific contexts in which AI solutions are implemented, the use of sensitive data, and the complexity of decision-making processes involved.
Nancy Pelosi also weighed in on the matter back in August, describing the bill as “well-intentioned but ill-informed.” She has since expressed her approval of Newsom’s decision to veto the bill.
